Option to Present a Major Production (Nonmusical)

An option differs from a simple license in several ways. A producer usually options a work when he intends to present its world premiere in a major production. A producer licesnse a script when his is one of many productions of the show, or he cannot mount the play at a level such that he would be entitled to the greater rights that producers ordinarily acquire in the typical option.  (MS Word document)

Commissioning a Playwright

Commissioning a playwright to create brand new works gives the producer a great deal more input into shaping a project than presenting an already written piece. The playwright follows certain, often very specific, guidelines, thereby writing a play that is suitable to the commissioning party's needs and desires. Whatever the reason for the commission, the producer and playwright are entering into a complex business and legal arrangement, which must be as carefully structured as the play itself. Production License (Simple)

Regional and small theaters frequently desire to present a production of an unpublished play in a simplified arrangement with the author. This form is designed for such circumstances. Most ot its clauses are boilerplate and should not be negotiated. Negotiable terms are fill in the blank clauses.   (MS Word document)

Joint Venture Agreement

Two or more parties band together for the purpose of carrying out a single business enterprise, for a limited time, in the hope of making a profit. For example, two more more producers create a joint venture for the purpose of raising funds ina theatrical limited partnership, to produce a show. Or two more more theater companies join together to produce a play, usually when the production is beyond the resources of each company individually.

Booking Agreement

Codifies the arrangement between the owner of a particular venue and the act the owner wishes to present. Owners or landlords may negotiate the contract directly with the performer (or his agent), or with another producer who is packaging the show. (MS Word document)
